Terms of Service

These Terms of Service ("Terms") govern your access to and use of Artist Sonar (the "Service"). By creating an account or using the Service you agree to these Terms. If you do not agree, please do not use the Service.

1. The Service

Artist Sonar is a tool for music producers to discover artists, manage contacts and collections, organise beat packages, and send outreach from their own connected accounts. Features and integrations may change, improve or be discontinued over time.

2. Provider

3. Accounts

You must provide accurate registration information and keep your login credentials confidential. You are responsible for all activity that happens under your account. You must be at least 16 years old, or the age of contractual capacity in your jurisdiction, to use the Service.

4. Subscriptions and payment

Access to the Service requires an active paid subscription, processed by our payment provider, Polar. Fees, billing cycle and any applicable taxes are shown at checkout. Subscriptions renew automatically for successive periods until cancelled. You can cancel at any time with effect at the end of the current billing period; unless required by law, paid fees are non-refundable for the period already started.

5. Third-party integrations

The Service lets you connect third-party accounts (including Apple Music, Last.fm, Dropbox, Google/Gmail and PayPal). Your use of those services is governed by their own terms and privacy policies. You are responsible for holding the necessary rights to any content you upload, store or send through the Service, and for complying with the terms of the platforms you connect. We are not responsible for third-party services or for content that resides in your own connected accounts.

6. Acceptable use

You agree not to:

  • use the Service to send spam, unlawful, infringing or harmful content;
  • violate the rights of others, including intellectual-property and data-protection rights;
  • attempt to gain unauthorised access to the Service or disrupt its operation;
  • use the Service to breach the terms of any connected third-party platform.

When you use the email feature, outreach is sent from your own connected address and you are solely responsible for that communication and for compliance with applicable anti-spam and marketing laws.

7. Your content

You retain all rights to the content you create, upload or store through the Service (such as your contacts, collections and beat packages). You grant us only the limited rights needed to operate and provide the Service to you — for example, to store your data and to relay it to the integrations you connect at your request.

8. Intellectual property

The Service itself, including its software, design and branding, is owned by the provider and protected by applicable laws. These Terms do not grant you any right to our trademarks or to copy or resell the Service.

9. Availability and changes

We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. We may modify, suspend or discontinue features, and we may update these Terms; where changes are material we will provide reasonable notice. Continued use after changes take effect constitutes acceptance of the updated Terms.

10. Disclaimer of warranties

To the extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that results obtained from the Service will meet your requirements.

11. Limitation of liability

To the extent permitted by applicable law, the provider shall not be liable for indirect, incidental or consequential damages, or for loss of data, profits or business, arising from your use of the Service. Nothing in these Terms limits liability that cannot be limited by law, including liability for intent or gross negligence.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms or use the Service unlawfully. On termination, your right to use the Service ends; sections that by their nature should survive (such as intellectual property, disclaimers and limitation of liability) will continue to apply.

13. Governing law

These Terms are governed by the laws of Switzerland, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer-protection rights of users in their country of residence remain unaffected. The place of jurisdiction, to the extent legally permissible, is Basel, Switzerland.
